electronic cargo manifests are limited to either the carrier, or a party
specifically approved by CBP. In this regard, an important consideration for ship
Owners and operators is that the regulations provide no authority for a
Ship's agent to file the necessary forms on their own behalf, or as an "agent" for the
Carrier. So it is quite clear that CBP does not accept submissions directly from the ship
husbanding or protective agencies. Although such agencies prepare
Data for transmission and may be allowed, the data are transferred, they are not
allowed their own SCAC or other distinctive sign on the place of use on any carrier
to form. This does not, however, that the ship operator or carrier must

To do this, a carrier must either purchase software and communication
Programs from an approved software vendor, or program their own software
Interface. This is a complex process that involves the submission of a Letter of Intent
with CBP, examinations and tests before implementation, and an IPO as
AMS participants. Accordingly, a direct interface is not recommended for carrier
if they are not already automated documentation systems, or the volume of
its obvious production makes this an attractive option.
