Default What rights does the consumer have if the goods are faulty or unsatisfactory? (UK-EU)


The new regulations do not specifically with the question of treating defective or faulty goods, but the usual statutory rights of consumers in any other type of purchase would not apply. Clearly, the consumer has in most cases, the 7-day cooling-off in which they return the goods.

In addition, the Sale of Goods Act 1979 provides for certain rights. It provides that the goods should be: -

(A) of satisfactory quality and safe to use.
(B) for the purposes for which you have bought, they fit.
(C) As described by the seller or on the packaging or display signs.

If the goods do not meet these standards, then the consumer can complain in a position to be located.

If consumers notice any problems with the goods when they were first given the chance to study them, then they can refuse and get their money back. You do not have to accept a replacement, free repair or credit. If they agree to repair, this will not prevent them from claiming their money back if the repair turns out to be unsatisfactory. The consumer does not lose the right to reject the goods by signing a delivery note recognition.

If the consumer does not notice the defect until later or used the goods for more than one attempt, then they can not refuse, but she can claim damages. What they can claim for the loss in value of the goods and for damage caused by its use, or inability to use them. This usually means repair, replacement or reduction in price.

Are there exceptions to this?

The consumer is not entitled to the goods in the following circumstances: -

• When she was told about the fault before you bought the goods.
• If the error was obvious and it would be reasonable, he said during the investigation, have before you bought it.
• If the consumer caused the damage himself.
• If they made a mistake, for example, they do not like the color, or is it the wrong size.
• They have changed their mind about the goods.
• You bought the goods more than 6 years.
