The regulations apply to online retailing and advertising. What the regulations provide that online advertising and sale is subject to the laws of the country where the supplier is located. For example, if the supplier is based in the UK, then the supplier will be subject to British law. It thus provides for "home" rule. For further information see Regulation 7 of the E-Commerce Regulations. How do the Distance Selling Regulation fit in with the E-Commerce Regulations? (UK-EU) The e-commerce regulations are in addition to replacing the Distance Selling Regulations and in no way does it. Rule 12 makes clear that all requirements under the E-commerce regulations in addition to the requirements found in the Distance Selling Regulations. |
