What happens if the goods entering with ATA carnet are not exported?
If the holder of a Carnet ATA sold or otherwise disposed of by donating any of the products listed on the carnet to the issuing organization is required to pay liquidated damages equal to 100 percent of the import duties and taxes. This organization in turn, will attempt to collect these monies from the holder of the Carnet, in violation of the conditions. In some cases, the land where the injury occurred to both the organization that issued the carnet and to hold the importer equally responsible. The importer is required to have his / her issuing association (and in some cases, the customs authorities of the country where it transpired) for all duties and / or taxes and other amounts that would normally be placed on the importation of such goods into account, as well as the amount in damages will be charged. If the U.S. Customs Service determines that there is fraud involved in the import, additional sanctions will be examined.
